City Ordinances

Snow Removal

In the City of Summerset, ordinances regulate snow and ice management to ensure public safety and compliance. Key regulations include:

• No Depositing Debris: It is unlawful to shovel or deposit snow, ice, or other debris from private property onto public streets, alleys, or rights-of-way, as this is considered a nuisance with penalties.

• Sidewalk Clearing: Property owners or occupants must clear snow and ice from sidewalks abutting their property within 24 hours after snowfall, to the full width of the sidewalk.

• City Removal and Costs: If owners fail to clear sidewalks, the city may remove snow or ice and assess the property owner for actual costs plus administrative fees, which are set by resolution.

• Annual Notification: The city publishes these requirements in the official newspaper for two weeks after the first City Commission meeting in October each year.

Assessment Process: Non-compliance costs are assessed annually, with property owners notified via publication and mail. The City Commission reviews and approves assessments each June.

Weeds, Trees, and Bushes

In the City of Summerset, ordinances regulate weeds, trees, and bushes to maintain public safety and neighborhood aesthetics. Key regulations include:

• Weed and Vegetation Control: Property owners must cut noxious or dangerous weeds, as defined by state or city authorities, and prevent domestic grass, weeds, or noxious vegetation from exceeding eight inches in height, as these are declared public nuisances.

• Tree and Bush Maintenance: Tree limbs or bushes hanging less than 12 feet above streets or eight feet above sidewalks are nuisances and must be removed. Vegetation obstructing traffic visibility may be ordered removed immediately by the Police Chief.

• Owner Responsibility: Owners must maintain vegetation on their lots and adjacent rights-of-way up to the street’s midpoint, ensuring no unmaintained weeds or vegetation remain.

• Notification Process: The Code Enforcement Officer notifies landowners of violations via certified mail or in-person, granting ten days to comply (or less if urgent). Initial notice requires ongoing compliance, with subsequent violations needing abatement within five days without further notice.

• City Removal and Appeals: If owners fail to comply, the city may remove vegetation and charge costs. Owners can appeal in writing to the Finance Officer within the given timeframe.
